Özet
The beginning of the provision of social services to disadvantaged groups such as the elderly, children and the disabled dates back to ancient times in Türkiye. The foundation culture in the Islamic faith has a very important place in the provision of social services, but since the last period of the Ottoman Empire, the state had to step in when the foundations could not meet the increasing needs for social services. The aim of this study is to reveal the legal arrangements made in the field of social services in Türkiye from the 1961 Constitution to the present day and the institutional progress in this field in an era when social services are now under the responsibility of states. Since the date range is very wide, the regulations on social services in the 1982 Constitution constitute the limit of the study. In this way, the historical background of social services in Türkiye can be seen as well as the current general framework with particular regard to the law regulating the operation of foundations. In the 1961 Constitution, the principle of social state was accepted for the first time and many provisions on social services were included in the Constitution. Although this was a very important basis for new legal regulations and organisations, this opportunity was not utilised very well throughout the period. It can be said that the frequent change of governments in Türkiye during the period (21 governments), the coalition formation of the majority of the governments and the lack of budget can be said to be effective in this. The 1982 Constitution, which is still in force today, has a very wide coverage of social services. It can be said that this situation means that Türkiye is once again recognised as a social state. In this study, archival documents, official publications, and copyrighted works in the literature were utilised. In addition, this study is a qualitative study and has been prepared by document analysis method.
